SUMMARY OF COPYRIGHT LAW BASICS
The works of artist Thomas R. Golden are protected under the federal copyright laws. PLEASE READ THIS SUMMARY CAREFULLY PRIOR TO SIGNING THE REQUEST FORM.
Exclusive Rights of Copyright Owner
Under 17 U.S.C. Section 106 of the federal copyright laws, the owner of a copyright has the exclusive right to do the following:
1. To reproduce the copyrighted works by making copies;
2. To prepare derivative works based upon the copyrighted work;
3. To distribute copies of the copyrighted work to the public by sale or other transfer of ownership, or by rental, lease or lending;
4. To display the copyrighted work publicly;
You must obtain authorization from the copyright owner to do any of the above. Copyright infringement is the unauthorized exercise of one of the rights that is exclusively reserved for the copyright owner. Examples of copyright infringement include, but are not limited to, any of the following actions performed without prior written permission from Comfort Prints™: making photocopies of the designs, scanning the designs onto a computer, printing a scanned design, displaying the design on a Web site, emailing the design to another person, videotaping the design, modifying the design and using the design in connection with paper products and other goods such as brochures, pamphlets, advertisements, books, note cards, stationary, posters, and key chains. There are many other actions that also constitute copyright infringement. Please ask if you have any questions regarding specific situations not covered above.
In addition, please note that copyright infringement can occur regardless of whether you represent a non-profit organization. Because a copyright owner has the exclusive right to make copies of the copyrighted work, all it takes is for you to make a single unauthorized copy of the copyrighted work to be in violation of the copyright laws. Engaging in copyright infringement may subject you to civil and criminal liability. 17 U.S.C. Sections 504, 505, and 506.
Obtaining Written Permission to Use a Copyrighted Work
Written permission obtained from the copyright owner to use a copyrighted work is known as a license. Copyright licenses are limited in scope and allow you to use the copyrighted work only for the specific purpose and in the specific manner identified in the license. For example, if you obtain permission to make 50 copies of a copyrighted work (e.g., to distribute 50 copies of a brochure containing the copyrighted work) and you create 51 copies of that brochure, the 51st copy made is considered an unauthorized copy that infringes the copyrighted work. Thus, it is very important that you notify the copyright owner of exactly how you will use the copyrighted work and obtain permission for such use. If you need to make additional uses or copies of the copyrighted work, you will need to obtain an additional license.
The permission you may be granted to use one of Thomas Golden’s copyrighted prints is non-transferable. This is standard in many copyright licenses. What that means is that the permission is personal to you or your company. You cannot transfer or assign the permission to any other person or company. You may not sell, loan or give a copy of the print to a third party. You may not store a copy of the print in your computer system after you have completed making all authorized copies. You may not e-mail the print or otherwise transfer the print electronically to another person or company unless specifically authorized in our permission letter. If you know of anyone interested in using our prints, please have them contact us directly.
The permission you may be granted will also be limited in time. You must conclude the permitted use by the expiration date. If you have not completed the permitted use by the expiration date, please contact us.
